The Single Judge Bench of the Delhi High court held that the complaint made by the appellant as well as reading his testimony clearly indicated that his relationship with the accused was also consensual.

The woman alleged that the man made physical relations with her for several months by promising marriage. According to the news agency ANI, the accused in this case was earlier acquitted from the trial court and now the High Court has also approved the verdict.

The single judge bench stated that reading of his testimony along with the complaint made by the appellant clearly indicated that his relations with the accused were also consensual. Justice Vibhu Bakhru said that there are some cases where women get ready to have sex on some occasions by getting stuck in the promise of marriage. While they do not have their full consent in this. It is ‘transient’ and in such a case can be tried under Section 375 of IPC.
The court said that but if someone has been having sex continuously and for a long time, then it cannot be assumed at all that such a long time was done only on the promise of marriage. The bench observed “As per the complaint of the woman, as stated by the trial court, she has said that in 2008, she had sexual relations with the accused and after three or four months, the man promised to marry.” And then she started living together.
